محامون يدعون إلى إرسال آلاف الرسائل إلى مجلس حقوق الإنسان بالأمم المتحدة لدعم خطواته في التحقيق في جريمة اختطاف وسجن "كاميليا شحاتة"

في إطار الدعوة إلى تفعيل حملة الدفاع عن الحرية للمواطنة "كاميليا شحاتة" التي اختطفت أثناء ذهابها إلى الأزهر من أجل إشهار إسلامها وتم حبسها في أحد المنشآت التابعة للكنيسة الأرثوذكسية ، توجه محامون مصريون بنداء إلى الرأي العام من أجل تفعيل التواصل مع مجلس حقوق الإنسان التابع للأمم المتحدة الذي قرر فتح تحقيق في الواقعة ، وقال نزار غراب المحامي في تصريحات للمصريون أنه من المهم بمكان وصول عشرات الآلاف من الرسائل الالكترونية أو الاتصالات إلى سكرتير المجلس من أجل دعم الجدية في التحقيق والإسراع بإعلان نتائجه ، ودعا نزار غراب باسم المحامين المدافعين عن قضية كاميليا كل إنسان شريف إلى إرسال نص الرسالة المرفقة مع هذا البيان إلى العناوين الموضحة به لدعم تلك الحملة التي من المؤكد ـ حسب قوله ـ أنها ستؤتي نتائجها الحاسمة في دعم حرية كاميليا شحاتة وغيرها من الذين يتعرضون لنفس الاعتداء الذي تعرضت له .

To Whom it May Concern:

I am writing to request your support and assistance regarding the case of Camilia Shehata, an Egyptian woman who is presumed to be held against her will by the Egyptian Church at an unknown location in Egypt. We are asking for all parties who are concerned with human rights to use their influence to call for an impartial investigation of the situation to ascertain Camilia's wherabouts, and to assure that she is safe and able to excercise her right to freedom of religion.

The growing phenomenon of ideological repression and institutional alliances

Recently, Egypt has witnessed a growing phenomenon of suppression of freedom of belief, due alliances between government and religious institutions. As a result, many crimes have been observed, the latest of which is a murder in Qaliubiya as a result of religion, when a Muslim was killed when his wife embraced Islam, in accordance with her right to freedom of belief.

Before this, there was another murder, with the same scenario and the same reasons, in the area of Hadaik al-Kubba in Cairo , and both of these crimes are being investigated by the designated courts.

On July 22, 2010, Camelia Shehata, an Egyptian private citizen, who also chose to convert to Islam in accordance with her right to freedom of belief, became the next victim in a series of crimes, including:

1. The government institutions responsible for confirming her conversion to Islam refused to accept her conversion as a result of State Security interference.

2. The aforementioned woman was held against her will by State Security, where she was accosted by insults and physical beatings, and then handed over to the Egyptian church.

3. The aforementioned woman continues to be held by the Egyptian Church at an unknown location.

4. The concerned authorities refused to investigate a complaint regarding these incidents rather than conducting an impartial investigation and announcing the findings to the general public (The complaint is Report no. 15013, August 12, 2010, which was submitted to the Attorney General).

These events constitute a violation of The International Covenant on Civil and Political Rights, to which Egypt is a party which is therefore considered to be a part of Egyptian law and its application is mandatory:

Article 5, paragraph 2, states, "There shall be no restriction upon or derogation from any of the fundamental human rights recognized or existing in any State Party to the present Covenant pursuant to law, conventions, regulations or custom on the pre#### that the present Covenant does not recognize such rights or that it recognizes them to a lesser extent."

Article 9, paragraph 1, states, "Everyone has the right to liberty and security of person. No one shall be subjected to arbitrary arrest or detention. No one shall be deprived of his liberty except on such grounds and in accordance with such procedure as are established by law."

Article 12, Paragraph 1, states, “Everyone lawfully within the territory of a State shall, within that territory, have the right to liberty of movement and freedom to choose his residence."

Article 17, Paragraph 1 states, "No one shall be subjected to arbitrary or unlawful interference with his privacy, family, home or correspondence, nor to unlawful attacks on his honour and reputation.”

Paragraph 2 of the same Article states, “Everyone has the right to the protection of the law against such interference or attacks.”

Article 18, Paragraph 1, states, “Everyone shall have the right to freedom of thought, conscience and religion. This right shall include freedom to have or to adopt a religion or belief of his choice, and freedom, either individually or in community with others and in public or private, to manifest his religion or belief in worship, observance, practice and teaching.”

Article 18, Paragraph 2, states, "No one shall be subject to coercion which would impair his freedom to have or to adopt a religion or belief of his choice.”

In light of these facts, it is clearly apparent that there is an ongoing attack being waged against freedom of belief by way of alliances between the government’s security services and the country’s religious institutions, which jeopardizes the citizen’s freedom to adopt a religion. Thus I am requesting that steps be taken, within the framework of the international covenants to which Egypt is party and which are thereby binding according to Egyptian law, to implement the legal guarantees that are necessary to bring forth the truth.
